Terms and conditions for using SkyEye

 

1. How SkyEye works

You only pay for those days, where your Lommy Blue has been sending data via SMS and/or GPRS.
 
You prepay for the use and therefore you will always know your cost.
 
When topping up, the amount is added to the deposit in your account. See 4. How to top up.
 
If your Lommy Blue unit is active and has been sending data, then the amount corresponding to the selected services is deducted from your account. This is always calculated as complete days from 00:00 to 23:59 regardless of the amount of data sent. The actual amount depends on your settings, selected options, and possible extra charges for use abroad.
 
If you have entered your mobile telephone number or your e-mail address, you will be notified when the amount in your account goes below 3,25 GBP. If all the money in your account is used, your Lommy Blue will with no prior warning stop working. Up until 3 months after this you can still log into your personal SkyEye page. After that your account and SIM-card is finally discontinued. If you want your Lommy Blue to start working again, you will need a new SkyEye SIM card. See part 11. How to buy a new SIM card and access a new SkyEye page.
 
Only SIM cards delivered by SkyEye can be used.
 

2. What you get

  • A SIM card is already mounted in your Lommy Blue. This SIM card is loaded with kr 75,00 which can be used to pay for sending data. You will also be given your personal login code to SkyEye. 
  • This can be used all days at all hours (24/7) to do the following:
  • Change username and password for your personal SkyEye internet page.
  • See the latest position and earlier positions on a map.
  • See earlier positions as a track on a map.
  • See earlier positions played fast forward.
  • See speed and direction.
  • Change the report interval (adjust the number of positions/day).
  • Buy various additional services.
  • Set up alarms.
  • Set up to 5 alarm users.
 

3. Minimum consumption and validity

After opening the account, a minimum consumption of kr. 15,00 will be charged. The calculation runs from the first, to the last day of each month, which is kr 0.50 per day, the device has not delivered data.
 
All consumption is deducted from the deposit in your account on a daily or monthly basis. It is not possible to use more money than what is in your account. The account balance cannot be negative. If the account reaches 0, the unit will stop working without any further warning. It will however be possible the following 3 months, to log into your personal SkyEye page. After the 3 months your SIM-card and internet-page are both closed down.
 
If you want to activate the unit before the 3 months period has expired, then you can reopen your subscription, if you pay a fee of kr 49,00. The account is re-opened automatically, if you deposit an amount.
 
In case you want to start using the unit again after the expiration of the 3 months, then you must buy a new subscription. To do this you must contact [email protected]. (See part 11).
 

4. Top up – how to deposit an amount in your SkyEye/Lommy Blue account

You can top up using your personal page on www.skyeye.eu.
 
You can deposit money all days including bank holidays, and the deposit will be added to the amount in your account. You can use a number of different debit- and credit cards.
 
Minimum deposit is 13 GBP.
 

5. Account information

At all times you will be able to see your account balance on www.skyeye.eu.
 

6. Changing prices and conditions

Changes of conditions and tariffs will be notified on www.skyeye.eu. Notification is done not less than 60 days prior to the day changes are effective.
If Skyeye estimates that a change is to the advantage of the customer, the change can take place without any prior notification. 
In case the contract is terminated before price changes are effective, the total amount in your SkyEye account will be transferred to your bank account.
 

7. Additional services

New functions and services are regularly added. These will be displayed on your personal site with www.skyeye.eu. You are free to buy any of these functions. Some are debited as a one time fixed fee. Others are debited on a monthly basis. Prices will be public as the services are developed. You will always be notified of the price before you buy.
 

8. Claims

According to consumer regulations you can claim problems with the product until 24 months after the purchase, on batteries and other wearing parts this is limited to 6 months. In case of claims the product must always be returned to the point of purchase. The claim right only covers production errors, i.e. new spare parts and repair time, or the supply of a replacement product, and return shipment. All other direct or indirect cost is not covered. Physically damaged units, units damaged by liquids or misused are not covered, but will be returned to the customer who will be charged a 20 GBP fee.
 

9. Operating conditions and responsibility

SkyEye has built the best possible reliability into the system. The system contains various advanced technological components, on some of which Skyeye has no influence. Therefore disturbances may occur. SkyEye cannot be made responsible for any direct or indirect losses, for whatever reason, including GSM network GPS network, GPRS network, internet, SkyEye server, Software errors, power failure, map supplier, or faults in the Lommy Blue unit.
 
It is the customers (consumers) own responsibility that the Lommy Blue and the SkyEye is only used for legal purposes, domestically and global. SkyEye undertakes no responsibility for how the product is used.
 

10. How to contact SkyEye support

SkyEye can be contacted via phone no +45 76 13 44 33 between 8 and 16 all workdays, or on e-mail using [email protected].
 

11. New SIM-card and a new personal SkyEye page

If your account has been closed down (No money in the account for 3 months or more) your Lommy Blue unit can be re started by contacting SkyEye at [email protected]. In certain cases it will be necessary to issue a new SIM card, and in other case the card can be reactivated. When contacting [email protected], you will receive a web link which you can use to deposit kr 275,00 in the Skyeye account. The kr 200,00 is an opening fee, and the balance of kr 75,00 will remain in your SkyEye account to pay for receiving position data.
 

12. Use of stored data

All position data which is stored, can and may be used for statistical purposes, including driving patterns, or can be sold to a third party, as long as the user identity is not revealed. Data describing the where abouts of persons are kept confidential and will only be given on based on a court order or if requested by the police.
 

13. Policy for data stored by www.skyeye.eu

When being registered as a customer with SkyEye, you will not need to give away any personal information. However certain contact information is needed. If you choose to give to SkyEye your personal data, this will be stored in our database. I.e. your name, address, e-mail, telephone number and your SkyEye password. This information is stored as long as you are a SkyEye customer. Information about your credit card is not stored in the system.
 
According to EU regulations SkyEye must keep record of all sales within the last 5 years. As a customer you are entitled to know which data we have recorded. In case you ask for such information, you will be charged a fee covering our cost finding the information.
 
All activities in www.skyeye.eu are registered anonymously in log files. The contents of these files will be used statistically, e.g. to know the number of visitors pr. day or hour etc.
 

14. Choosing GSM provider and supplier of maps

SkyEye is free to change the GSM network provider or to link to a different supplier of maps. SkyEye always negotiates the best and cheapest prices with its suppliers, to the benefit of the SkyEye customers. As a result of this, SkyEye may choose to replace your SIM-card. If your SIM card needs to be replaced, this will be done without any cost to you as a customer. The amount in your account will stay unchanged. You will only need to exchange the SIM-card.
 

15. SIM-card abuse

Your Lommy Blue contains a SIM-card. This must not be removed and used for other purposes without prior agreement. If SkyEye suffer losses related to abuse of the SIM card, you as a customer will be responsible to SkyEye.
 

16. Lost Lommy Blue units with SIM-card

If your Lommy Blue unit including the SIM-card is lost, you must immediately report this to SkyEye. To prevent abuse of the SIM-card this must be done without any delays. Call the SkyEye telephone-support and report the username, you are using for www.skyeye.eu. Alternatively you can report the serial number of your Lommy Blue unit. If the unit is lost outside regular business hours, then you must send an e-mail to [email protected].
 

17. New owner

You are free to sell your Lommy Blue unit. In www.skyeye.eu you can remove all personal information and position data from your SkyEye-account, to provide the new owner with a fresh account. To do this, SkyEye requires that the amount left in your account is not less that kr 175,00. SkyEye will charge kr 100,00 for changing the account to a new owner, and the balance will remain in the account for the new owner to use.
 

18. Lost login

If you forget your username and password for your personal pages in www.skyeye.eu, you can receive this information again by typing in the serial number of your Lommy Blue on www.skyeye.eu. Username and password will then be sent to the e-mail address, you have originally registered on SkyEye. See more about this at www.skyeye.eu/support.
 

19. Termination

You are free to terminate your service with SkyEye, and have the amount remaining on your SIM-card returned to you if the balance  is more than 7 GBP. Termination must be done in writing to SkyEye, and contain information about the serial number of your Lommy Blue unit, and your password for www.skyeye.eu.
 

20. Prices and tariffs

SMS to domestic mobile numbers: kr 0,50.
E-mails: Free
Reopening a closed account (if your account is empty for less than 3 months): kr 49,00.
Opening a new account including a new SIM-card (your account has been empty for mote than 3 months): kr 200,00

All prices include local VAT.
 

21. Use abroad

If the Lommy Blue unit sends data back to you from abroad, the charge for doing that will be approximately 5 times the domestic charge. I.e. if you have chosen to receive 0ne position every hour, the charge will be kr 2,50 for one day, when data are received from abroad. If you only receive data from within your own country, the daily charge will be kr 0,50 for one position every hour.
